TERMS AND CONDITIONS


The following is a list of standard terms and conditions used by photographers; these are provided in the interests of both the client(s) and the photographer(s). Please read these terms before placing your booking.

Booking Fee: The purpose of the booking fee is to secure the photographer(s) for a particular time and date therefore cannot be refunded or transferred in the event of cancellation by the client(s).

Payment: Full payment of the remaining balance is required no later than 30 days before the wedding. Payment may be made by cash, bank transfer (20-62-53 ********) or cheque which should be made payable to Mr R Buttle only. All prices are fully inclusive of VAT (if applicable) and are fixed at the time of booking.

Cancellation by Client: In the event of cancellation by the client(s), an additional fee of £200 will become payable at the time of cancellation. The purpose of this fee is to cover the loss of earnings caused by the cancellation.
This fee will be returned in full, should another couple subsequently re-book the date. 

Cancellation by the Photographer(s): In the unlikely event that the photographer(s) is forced to cancel this Contract for reasons beyond control or unforeseen circumstances preventing wedding attendance (i.e. serious injury or death), liability is limited to a full refund of monies paid to date only. The photographer(s) may contact other service providers in the event that they are not able to attend your booking due to the above. However it may prove difficult or impossible to find a skilled replacement photographer(s) especially at short notice or at the same price.

Copyright: The ‘1988 copyright, designs & patents act’ assigns the copyright to the photographer(s) unless agreed otherwise in writing. It is understood that images taken under this contract may on occasions be used for advertising, display, competition or any other purposes thought proper by the photographer(s) without compensation or liability to the contracting party.

Image Files: High resolution image files are provided to the client(s) for their personal use only and are supplied with the 'right to print'. It is agreed that it is the sole responsibility of the client(s) to backup and store the supplied images on CD or DVD for the future. No liability can be held for loss or damage to image files after safe delivery to the client(s). Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer(s) will not be responsible for photographs that are not supplied due to technical failure, either at the shooting or processing stage. Where products are made available for use with personal computers the default operating system shall be Windows 10 business edition. Products may not function on other or earlier operating systems.

Lighting Conditions: Due to a variety of lighting conditions and the limitations of digital sensors and other equipment, some colours may alter throughout a set of photographs. Please note that certain colours do not reproduce exactly in print.
It is understood that all printing is undertaken within the technical limitations of the process and that colour may not be identical over the whole range of colours within a subject. It is also understood that prints made at different times or in different sizes may be variable in colour balance. Due to the limitations of computer monitors it is understood that images appear differently according to the specification of each monitor, prints will not match images rendered on any particular computer monitor.

Exclusivity: It is agreed that the photographer(s) shall be the sole professional stills photographer on the wedding day. Although the photographer(s) will actively encourage the use of cameras throughout the wedding it is agreed that the photographer(s) shall reserve the right to ask guests to refrain from taking photographs in the event that their activities are corrupting the official photography in any way. For example flashes, obstruction or distractions etc.

Special Requests/Coverage: The photographer(s) shall endeavor to photograph all individuals and events as requested by the client(s) at some point, but no responsibility will be taken by the photographer(s) on the occasion of omissions. For a booking involving a church ceremony or at certain venues, the photographer(s) movements may be restricted by the official in charge or by the physical characteristics of the venue. The areas from which the photographer(s) can cover the ceremony may not be the photographer(s) choice and the photographer(s) cannot accept responsibility for any obstructed view degradation's or omissions should this be the case. The use of artificial lighting may be restricted or prohibited. The photographing of parts or even all of the ceremony may be restricted or prohibited. 

Artistic Licence: When possible the photographer(s) will work with the client(s) to find the most suitable locations for both background content and quality of lighting however it is agreed that the photographer(s) shall be granted full creative and artistic licence regarding locations, poses and groups. The photographer(s) final judgement on photographic style, allocated time and the number of photographs taken shall be deemed correct. Due to changes of the weather and the availability and willingness of subjects, the photographer(s) will do their best to honour requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or arrangement.
